Holiday Let Hire Contract
By paying the deposit/balance to the Owners of Spey Cottage, Tobermory, the Hirer agrees that they have entered into a hire contract with the said Owners as per the terms and conditions described in this document –
The Hirer must be one of the party staying in the Property for duration of the Hire Period.
The Hirer has the right to occupy the property exclusively as a holiday let for the hire period only and this period can only be extended with the permission of the Owners.
Bookings must be made by a person over the age of 18.
A deposit of £150 per week is taken at the point of the provisional booking being made. The balance of payment becomes payable six weeks prior to the booked date.
Bookings made less than 6 weeks prior to the commencement of the Hire Period must be paid in full at the time of booking.
Failure to pay the deposit or balance of the booking fee in full by the due dates will constitute a cancellation of the booking by the Hirer.
The Hire will be allowed to occupy the Property from 3pm on the first day of the Hire Period and must vacate the Property by 10am on the last day of the Hire Period unless otherwise agreed with the Owners.
The Owners strongly recommend that the Hirer take out holiday insurance. In the event of a cancellation by the Hirer, the Owners will endeavour to re-let the Property and, if successful, a refund may be made, however, in circumstances where the cancellation is made less than two weeks before arrival, no refund will be available.
The Owners will endeavour to ensure that the Property is available for the dates booked. In the unlikely event the Property becomes unavailable and the Owners have to cancel the booking, the Owners will endeavour to find the Hirer suitable alternative accommodation. If suitable alternative accommodation cannot be found, the Owners will be entitled to a full refund. The Owners shall only be liable to return monies received. No compensation or consequential losses shall be paid.
If for any reason beyond the control of the Owners or the Agent the Property is unavailable on the day when the booking is due to begin, or the Property becomes unsuitable for holiday letting, neither the Owners or the Agent will, either jointly or individually, accept any liability to the Hirer or pay any compensation.
The Hirer accepts that the Owners grants no warranty in their description of the Property. The Hirer accepts that no refunds are available for such changes and that no liability attaches to the Owners for any such change.
The property is in a rural location and the Owners and the Agent offer no guarantee as to availability of television, radio, Wi-Fi, mobile telephone, mobile data or any other communications service.
